Florida Legislators are
working hard to negotiate compromises that will be
reflected in pending legislation that will affect
homeowner and condo owners.
Senate Bill 995 possesses some
redeeming qualities but about 85% of it is detrimental
to community associations. The bill includes such
changes as:
1) prohibits staggered terms for
directors. Why? Nobody knows why this is in there.
2) if the Association owns a unit (which many do due
to the increase in foreclosures) the the Bill strips
away any voting rights.
3) removes the ability to opt out of the cumbersome
statutory election procedures.
4) takes away the ability to waive statutory financial
reporting (audit, review or compilation) more than 2 consecutive
years in a row.
5) requires free expression of religion on condominium
premises BUT does not define what
"religious expression" is.
6)makes it a criminal and civil crime for any
director, officer or manager who knowingly or
intentionally defaces, destroys or FAILS TO CREATE OR
MAINTAIN ACCOUNTING RECORDS. There is no definition of
MAINTAIN !!
We can not allow Senate Bill 995
or 995a pass. Please email your local State Senator
and the governor and voice your displeasure with this
legislation.
